Early Access Program Agreement
Current Version: 1.0.0
Last Updated: April 1, 2026
Effective Date: April 1, 2026
1. How this Agreement Applies
This Early Access Program Agreement ("EAP Agreement") is incorporated into the Master Services Agreement. It applies whenever Customer or any user accesses or uses any service, product, feature, functionality, integration, plan, tool, module, documentation, API, workflow, design, product area, offering, or other item that we identify or make available as "Beta", "Preview", "Early Access", "pilot", "alpha", "experimental", "pre-release", "limited availability", or any similar label (each an "Early Access Offering").
If this EAP Agreement conflicts with the Master Services Agreement, this EAP Agreement controls for the Early Access Offering only. The Master Services Agreement controls for all other services.
2. Experimental Nature
Early Access Offerings are made available for evaluation, testing, feedback, and limited use. They may be incomplete, unstable, inaccurate, unsupported, unavailable, changed, suspended, withdrawn, or discontinued at any time. They may not operate correctly, may lose or corrupt data, may perform differently across accounts, and may never become generally available.
Customer should not rely on an Early Access Offering for mission-critical, payroll, legal, compliance, safety, wage-and-hour, employment, or other production decisions unless Customer independently verifies the output and accepts the risk.
3. Changes to Features, Billing, and Availability
We may change any Early Access Offering at any time, including its availability, eligibility, feature set, workflow, user interface, data model, limits, pricing, billing basis, packaging, plan placement, quotas, access controls, documentation, support level, names, labels, and integration behavior. We may make an Early Access Offering free, paid, metered, usage-based, limited to certain customers, limited to certain users, generally available, or unavailable.
Access to an Early Access Offering does not create a right to continued access, a right to a particular price, a right to grandfathered packaging, or a commitment that the offering will remain available on the same terms.
4. No SLA, Warranty, or Roadmap Commitment
Early Access Offerings are excluded from any service-level commitments, support commitments, uptime commitments, warranties, indemnities, credits, remedies, or roadmap commitments unless we expressly state otherwise in writing. They are provided "AS IS", "AS AVAILABLE", and with all faults.
5. Data and Telemetry
Data submitted to an Early Access Offering is Customer Data under the Master Services Agreement unless we provide a feature-specific notice. We may collect and use telemetry, diagnostics, usage information, feedback, logs, performance data, error data, and interaction data to test, operate, secure, support, analyze, improve, modify, or discontinue Early Access Offerings.
Customer is responsible for deciding whether Customer Data is appropriate for an Early Access Offering and for backing up or exporting data where needed.
6. Feedback
Customer and users may provide ideas, requests, comments, bug reports, usability notes, or other feedback about Early Access Offerings. We may use feedback without restriction, obligation, or compensation, including to improve existing services or develop new products, features, or offerings.
7. Confidentiality
Non-public Early Access Offerings, related documentation, designs, pricing, roadmap information, performance, limitations, and communications are our confidential information unless we state otherwise. Customer may not disclose or publish information about non-public Early Access Offerings without our written permission.
8. Access Controls and Removal
We may grant, limit, suspend, revoke, or condition access to Early Access Offerings at any time, with or without notice. We may require acceptance of additional terms, eligibility criteria, technical requirements, security requirements, or separate written approval before enabling an Early Access Offering.
9. Customer Responsibility
Customer is responsible for user training, review of outputs, workflow decisions, employee notices, legal compliance, and any business decisions made using Early Access Offerings. Customer must not use Early Access Offerings in violation of law, the Master Services Agreement, or any instructions we provide.
